The terms "we", "us" and "AirportBars.com" refer to AirportBars.com LLC.
The terms "you" and "your" refer to you, as a user of the Site. A "user" is anyone who accesses, browses, crawls, scrapes, or in any way uses the Site.
The following are the rules that govern use of the AirportBars.com Web Sites (including all international versions of AirportBars.com), and their respective applications and interfaces for mobile devices (collectively, the "Site"). By using or visiting the Site, accessing, browsing, crawling, scraping or in any way using the Site, you expressly agree to be bound by these Terms of Use and to follow these Terms of Use and all applicable laws and regulations governing the Site, our privacy policy (the "Privacy Policy"), and all other guidelines or policies referenced herein (collectively, the "Terms of Use"). AirportBars.com reserves the right to change these Terms at any time, effective immediately upon posting on the Site. Please read the Terms of Use carefully. Your use of the Site constitutes your acceptance of the Terms of Use. Do not use the Site if you are unwilling or unable to be bound by the Terms of Use.
"Content" means text, images, photos, audio, video, and all other forms of data or communication. "Your Content" means Content that you submit, post, or transmit to, or using, the Site, such as the business ratings, reviews, compliments, information that you display as part of your account profile, invitations, or other commentary that you may submit, post, or transmit to, or using, the Site. Your Content does not include the information that you submit in order to create an account on the Site. "User Content" means Content that users submit, post, or transmit to, or using, the Site. "AirportBars.com content" Or "Editor's content" means Content that is created by AirportBars.com and made available on the Site. "Third Party Content" means Content that is made available on the Site by parties other than AirportBars.com or the users, such as data providers that license data to AirportBars.com for use on the Site. "Site Content" means all of the Content that is made available on the Site, including Your Content, User Content, Third Party Content, and AirportBars.com / Editor's Content.
Permitted Use
You agree that you are only authorized to visit, view, and retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify, or otherwise distribute the material on this Site for any commercial use, or for any purpose other than as described in these Terms. You also agree not to deep-link to the Site for any purpose, unless specifically authorized by AirportBars.com.
Eligibility
You must be of legal drinking age to use this Site. If you use the Site on behalf of a company, entity, or organization, you must be an authorized representative with the authority to bind it to the Terms of Use (which authority you hereby exercise).
Use Void Where Prohibited
Use of the Site is void where prohibited. By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into this Terms of Use and to abide by all the Terms of Use.
Changes To The Terms Of Use
The Terms of Use may be modified by AirportBars.com at any time. You should revisit these Terms of Use on a regular basis as revised versions will be binding on you. Any such modification will be effective upon AirportBars.com's posting of new Terms of Use. Your continued use of the Site after any posted modification to the Terms of Use indicates your acceptance of the modification.
Registering with AirportBars.com
In order to take advantage of certain features on the Site, you may be required to create an account and provide information about yourself to us. For example, If you would like to post a consumer review and rate an airport bar, you will be required to register to be able to do so. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to close your account at any time for any or no reason or take any other action that AirportBars.com believes is appropriate. AirportBars.com use of any personal information that you provide to AirportBars.com during any registration process is governed AirportBars.com Privacy Policy.
There are two types of accounts:
A "Basic Account" is an account for your personal, non-commercial use only, and may be used to submit, post, and transmit reviews, ratings, messages, compliments, invitations, commentary, photographs, and other types of User Content. In creating a Basic Account, we ask that you provide complete and accurate information about yourself in order to bolster your credibility as a contributor to the Site, though you may opt instead to provide information that does not make you personally identifiable. Notwithstanding the foregoing, you may not impersonate someone else (e.g., adopt the identity of a celebrity or your next-door neighbor), provide an email address other than your own, or create multiple Basic Accounts.
A "Bar Owner Account" is an account for use on the Site as a representative of a bar that is listed on the Site. In creating or updating a Bar Owner Account, you must be an authorized representative of the bar in question, and you must provide complete and accurate information about yourself and the bar you represent. You may not provide an email address that is not your own or create multiple Bar Owner Accounts for the same bar. If however, you own multiple bars, you may create one Bar Owner Account for each bar. Bar Owner Accounts are by default a 'Free Basic Listing'. A Bar Owner Account may be upgraded and enhanced, at a cost, to a 'Sponsored Listing' at the discretion of the representative of the Bar Owner Account.
Use Of The Site:
Subject to the restrictions in these Terms of Use, AirportBars.com grants you permission to use the Site, including the ability to: search for Airport Bars, as well as read, write, and share reviews about airport bars.
You will be exposed to User Content and Third Party Content on the Site. You understand that such content may be offensive, indecent, inaccurate, objectionable, or otherwise inappropriate. AirportBars.com does not endorse User Content or Third Party Content, and cannot vouch for its accuracy.
Posting Reviews on AirportBars.com
AirportBars.com reserves the right, but not the obligation, to refuse to post or to remove any review if it contains or features any of the following:
• Unacceptable Content:
1. Content that contains personal attacks or describes physical confrontations and/or sexual harassment.
2. Language that violates the standards of good taste or the standards of this website, as determined by AirportBars.com in its sole discretion.
3. Reviews that do not address the goods and services of the business or reviews with no qualitative value (e.g., "this place is cool!") as determined by AirportBars.com in its sole discretion.
4. Language intended to impersonate other users (including names of other individuals) or offensive or inappropriate user names or signatures.
5. Offensive, harmful and/or abusive language, including without limitation: expletives, profanities, obscenities, harassment, vulgarities, sexually explicit language and hate speech (e.g., racist/discriminatory speech.)
6. Content that is not in English, that is encrypted or that contains viruses, trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, interfere with, intercept or appropriate any system, data or personal information.
7. Content determined by AirportBars.com to be illegal, or to violate any federal, state, or local law or regulation or the rights of any other person or entity.
8. References to illegal activity, malpractice, purposeful overcharging, false advertising or health code violations (e.g., food poisoning, foreign objects in food, etc.)
9. Excessive damage caused by business or service to person or property.
10. Reviews commenting on other users.
11. Reviews submitted by the reviewed business's employees (past or present) or competitors as determined by AirportBars.com
12. Messages that are advertising or commercial in nature, or are inappropriate based on the applicable subject matter.
13. Personal information or messages including email addresses, URLs, phone numbers and postal addresses.

Reviews do not reflect the views of AirportBars.com; or any entity or individual that is associated with AirportBars.com LLC.
AirportBars.com does not assume responsibility or liability for any review or for any claims, damages, or losses resulting from any use of the Site or the materials contained therein.
• Reviews are owned by AirportBars.com
Reviews that are submitted to AirportBars.com shall be owned exclusively and in perpetuity by AirportBars.com. Such exclusive ownership means that AirportBars.com has the unrestricted, perpetual, and exclusive right to use, reproduce, modify, translate, transmit, reformat, edit, publish, associate it with your account name, incorporate it into other works, create derivative works from it, promote, license these same rights to third parties for use in connection with other media platforms ("Other Media"), and distribute any and all materials and communications regarding and including submitted reviews. AirportBars.com is under no obligation to give credit or pay any consideration to you for your reviews. You grant the Site's users and the users of any Other Media the irrevocable right to access your content in connection with their use of the Site and any Other Media. You irrevocably waive, and cause to be waived, any claims and assertions of moral rights or attribution with respect to your content.
• Responsibility For Your Content
You are solely responsible for Your Content. You assume all risks associated with use of Your Content, including any reliance on its accuracy, completeness or usefulness by others, or any disclosure by you of information in Your Content that makes you personally identifiable. You represent that you own, or have the necessary permissions to use, and authorize the use of Your Content as described herein. You may not imply that Your Content is in any way sponsored or endorsed by AirportBars.com.
Because you alone are responsible for Your Content (and not AirportBars.com), you may expose yourself to liability if, for example, Your Content violates a third party's rights, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; contains material that is false, intentionally misleading, or defamatory; contains material that is unlawful, including illegal hate speech or pornography; exploits or otherwise harms minors; or violates or advocates the violation of any law or regulation.
• Use of Content
AirportBars.com may or may not use User Content in its sole discretion. For example, we may choose not to publish User Content if we believe it violates the Terms of Use. In addition, please note that we have no obligation to retain or provide you with copies of Your Content, nor do we guarantee any confidentiality with respect to Your Content.
• AirportBars.com and its licensees may display advertisements and other information adjacent to or included with Your Content on the Site and Other Media. You are not entitled to any compensation for such advertisements. The manner, mode and extent of such advertising are subject to change without specific notice to you.

Restrictions On Use:
You agree that you will not:
1. Use the Site for keyword spamming or to otherwise attempt to manipulate search results.
2. Use the Site to transmit or post spam, chain letters, contests, junk email, pyramid schemes, surveys, or other mass messaging, whether commercial in nature or not.
3. Access, retrieve or index the Site to construct or populate a searchable database of business reviews.
4. Use the Site to transmit or post pornography or illegal content.
5. Use the Site to threaten, stalk, defraud, incite, harass, or advocate the harassment of another person, or otherwise interfere with another user's use of the Site.
6. Reformat or frame any portion of the Site.
7. Use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve, scrape, or index the Site or any Site Content.
8. Use the Site to promote bigotry or discrimination against protected classes.
9. Attempt to gain unauthorized access to the Site, user accounts, computer systems or networks connected to the Site through hacking, password mining or any other means; use the Site or any Site Content to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses"); use any device, software or routine that interferes with the proper working of the Site, or otherwise attempt to interfere with the proper working of the Site; make excessive traffic demands; use the Site to violate the security of any computer network, crack passwords or security encryption codes; disrupt or interfere with the security of, or otherwise cause harm to, the Site or Site Content; remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Site, features that prevent or restrict the use or copying of Site Content, or features that enforce limitations on the use of the Site.
10. Take any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on AirportBars.com technology infrastructure.
11. Use the Site for promotional or commercial purposes, except as expressly permitted by AirportBars.com.
12. Use the Site to solicit personal information from minors or to harm or threaten to cause harm to minors.
13. Use the Site in violation of the Terms of Use or any applicable law.
14. Use the Site to violate any third-party right, including any breach of confidence, copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
15. Use the Site in a manner that may create a conflict of interest, such as trading reviews with other business owners or writing or soliciting shill reviews.
16. Remove or modify any copyright, trademark or other proprietary rights notice on the Site or on any materials printed or copied off of the Site;
17. Reverse engineer any portion of the Site, except as may be permitted under the law.
18. Record, process, or mine information about other users.
19. Modify, adapt, appropriate, reproduce, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit the Site or Site Content (other than Your Content), except as expressly authorized by AirportBars.com.
Search and Links Results
The Site may automatically produce search results that reference or link to third-party sites throughout the world wide web. AirportBars.com has no control over these sites or the content within them. AirportBars.com cannot guarantee, represent, or warrant that the content contained in these sites is accurate, legal, and/or inoffensive. AirportBars.com does not endorse the content of any third-party site, nor do we warrant that it will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against AirportBars.com for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify AirportBars.com, and AirportBars.com will investigate your claim and take any actions AirportBars.com deems appropriate at our sole discretion.
Bar listings located on AirportBars.com are selected for display in search results based primarily on their account type: 'Sponsored Listings' will be at the top of the list and their order will be determined by AirportBars.com in our sole discretion, 'Free Basic Listings' will be lower on the list and their order will be determined in either alphabetical order, or based on their content in relation to the user-provided search terms/filters. Consequently, both 'Sponsored' and 'Free Basic' listings will be included in a search results list.
Offline Conduct
Although AirportBars.com cannot monitor the conduct of its users off the Site, it is a violation of these rules to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any user without his/her prior explicit consent.
Site Availability
AirportBars.com reserves the right (but is under no obligation) to modify, update, or discontinue the Site at its sole discretion, at any time, for any or no reason, and without notice or liability.
Access and InterferenceYou agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorized purpose without our prior expressed written permission. You agree that you will not use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site. You agree that you will not copy, reproduce, alter, modify, create derivative works from, or publicly display any content (except for your own personal, non-commercial use) from our Web Site without the prior expressed written permission of AirportBars.com.
Unauthorized Access
AirportBars.com reserves the right to exercise whatever lawful means it deems necessary to prevent unauthorized access to or use of the Site, including, but not limited to, technological barriers, IP mapping, and contacting your Internet Service Provider (ISP) regarding such unauthorized use.
Unauthorized Use of the Site
Illegal and/or unauthorized uses of the Site, including, but not limited to, unauthorized framing of or linking to the Site or unauthorized use of any robot, spider, or other automated device on the Site, will be investigated and subject to appropriate legal action, including, without limitation, civil, criminal, and injunctive redress.
Investigations
AirportBars.com is under no obligation to monitor the Site or Site Content. However, we reserve the right to investigate possible violations of the Terms of Use, block users from the Site, and refer matters to law enforcement authorities for further investigation. AirportBars.com may disclose information to third parties, including Your Content, in accordance with its Privacy Policy.
Children
You may not use the Site if you are under the legal drinking age.
Feedback
• Suggestions and Improvements. By sending us any ideas, suggestions, documents and/or proposals ("Feedback"), you agree that (i) your Feedback does not contain the confidential or proprietary information of third parties, (ii) we are under no obligation of confidentiality, express or implied, with respect to the Feedback, (iii) we may have something similar to the Feedback already under consideration or in development, and (iv) you grant us an irrevocable, non-exclusive, royalty-free, perpetual, worldwide license to use, modify, publish, distribute and sublicense the Feedback.
• Dissatisfaction. If you are dissatisfied with the Site, please let us know by providing feedback to the customer support team through our feedback page. Your input is valuable to us. Your only other remedy with respect to any dissatisfaction with (i) the Site, (ii) the Terms of Use, (iii) any policy or practice of AirportBars.com in operating the Site, or (iv) any content or information transmitted through the Site, is to terminate the Terms of Use and close your account.
Termination
AirportBars.com may terminate or suspend your account or ability to use the Site, in whole or in part, at AirportBars.com's sole discretion, for any or no reason, and without notice or liability of any kind, including but not limited to termination or suspension of your account or ability to use the Site if you breach the Terms of Use or are suspected of involvement in illegal activity. Any such termination or suspension could prevent you from accessing your account, the Site, Your Content, Site Content, or any other related information. You may terminate the Terms of Use at any time by closing your account, discontinuing your use of any and all parts of the Site. In the event of any termination, whether by you or us, the Terms of Use will continue in full force and effect, including AirportBars.com's rights with respect to Your Content.
Violation of the Terms
You agree that monetary damages may not provide a sufficient remedy to AirportBars.com for violations of these terms of use and you consent to injunctive or other equitable relief for such violations.
Ownership
AirportBars.com owns the AirportBars.com Content, including but not limited to visual interfaces, interactive features, graphics, design, compilation, computer code, products, software, aggregate user review ratings, and all other elements and components of the Site excluding User Content and Third Party Content. AirportBars.com also owns the copyrights, trademarks, service marks, trade names, and other intellectual and proprietary rights throughout the world (the "IP Rights") associated with the AirportBars.com Content and the Site, which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. As such, you may not modify, reproduce, distribute, create derivative works or adaptations of, publicly display or in any way exploit, any of the AirportBars.com Content in whole or in part except as expressly authorized by AirportBars.com. Except as expressly and unambiguously provided herein, AirportBars.com does not grant you any express or implied rights, and all rights in and to the Site and the AirportBars.com Content are retained by AirportBars.com.
DISCLAIMERS, WARRANTIES, and LIMITATIONS OF LIABILITY
AIRPORTBARS.COM DOES NOT PROMISE THAT THE SITE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL PROVIDE SPECIFIC RESULTS FROM USE OF THE SITE OR ANY CONTENT, SEARCH, OR LINK ON IT. THE SITE AND ITS CONTENT ARE DELIVERED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. AIRPORTBARS.COM CANNOT ENSURE THAT FILES YOU DOWNLOAD FROM THE SITE WILL BE FREE OF VIRUSES OR CONTAMINATION OR DESTRUCTIVE FEATURES. AIRPORTBARS.COM FURTHER DISCLAIMS ALL LIABILITY FOR ANY LOSS OR DAMAGE ARISING OUT OF YOUR USE OF THE SITE AND SITE CONTENT. YOUR USE OF THE SITE AND SITE CONTENT IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY RESULTING LOSS OR DAMAGE, INCLUDING BUT NOT LIMITED TO ANY LOSS OF DATA OR DAMAGE TO YOUR COMPUTER FROM VIRUSES THAT MAY BE DOWNLOADED TO YOUR COMPUTER IN THE COURSE OF USING THE SITE.
AIRPORTBARS.COM DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS, AND CONDUCT OF ANY THIRD-PARTY USERS, AIRPORTBARS.COM USERS, ADVERTISERS, AND/OR SPONSORS ON THE SITE, IN CONNECTION WITH THE SITE, OR IN ANY WAY RELATED TO THE SITE.
Without limiting the foregoing, you may report the misconduct of users and/or third-party advertisers or service and/or product providers referenced on or included in the Site to AirportBars.com. AirportBars.com may investigate the claim and take appropriate action, at its sole discretion.
The foregoing limitations will apply even if the above stated remedy fails of its essential purpose. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.
Disputes
These Terms of Use shall be governed by and construed in accordance with the laws of the state of Oregon, without regard to conflicts of laws provisions. You and AirportBars.com agree that the United States District Court for the District of Oregon and/or the Multnomah County Court shall have exclusive jurisdiction over any dispute between you and AirportBars.com relating in any way to the AirportBars.com service or Site or these Terms of Use. You and AirportBars.com expressly and irrevocably consent to personal jurisdiction and venue in these courts. The parties agree that in any such dispute or subsequent legal action, they will only assert claims in an individual (non-class, non-representative) basis, and that they will not seek or agree to serve as a named representative in a class action or seek relief on behalf of those other than themselves. If any provision or provisions of these terms shall be held to be invalid, illegal, unenforceable or in conflict with the law of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby, and shall remain in full force and effect.
Indemnity
You agree to indemnify and hold AirportBars.com, its subsidiaries, affiliates, officers, agents, and other partners and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Site, including your use of the Site to provide a link to another site or to upload content or other information to the Site.
Miscellaneous
No agency, partnership, joint venture, or employment is created as a result of the Terms of Use, and you do not have any authority of any kind to bind AirportBars.com in any respect whatsoever.
AirportBars.com may provide you with notices, including those regarding changes to the Terms of Use by email, regular mail or postings on the Site.
The Terms of Use contain the entire agreement between you and AirportBars.com regarding the use of the Site, and supersede any prior agreement between you and AirportBars.com on such subject matter. The parties acknowledge that no reliance is placed on any representation made but not expressly contained in these Terms of Use.
The failure of AirportBars.com to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.
If any provision of the Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms of Use shall otherwise remain in full force and effect and enforceable.
The Terms of Use are not assignable, transferable or sublicensable by you except with AirportBars.com's prior written consent, but may be assigned or transferred by AirportBars.com without restriction. Any assignment attempted to be made in violation of the Terms of Use shall be void.
The section titles in the Terms of Use are for convenience only and have no legal or contractual effect.
THIS SITE IS INTENDED FOR AUDIENCES OF LEGAL DRINKING AGE ONLY
AirportBars.com is intended for responsible adults of legal drinking age. AirportBars.com is intended for informational purposes only.
We do not advocate the abuse of alcoholic beverages. If you do decide to consume alcoholic beverages at an airport bar that is listed on the Site, you shall do so with moderation and caution and at your own risk. It is not our intent to promote the misuse of alcohol, alcoholism, binge drinking, or any other form of alcohol abuse.
AirportBars.com cannot take any responsibility for the effect alcoholic beverages consumed at airport bars may have on anyone.
Please keep these things in mind:
• Never drink and drive and never drink and fly. You will end up killing yourself, or worse, someone else.
• If the law in your country says you're too young to drink, don't.
• Do not drink too much. Alcohol poisoning may be lethal.
• If you have a problem with drinking, seek professional help.
